The developer and the project
1.1 Lucean Bay Jomtien Pattaya (the "Project") is developed and sold by Lunique Real Estate Co., Ltd. (the "Company"), Company Registration No. 0125559017832, registered capital THB 800,000,000.00, with its office at 66 Moo 12, Nong Prue Subdistrict, Bang Lamung District, Chonburi.
1.2 The Project is located on Jomtien Second Road, Nong Prue Subdistrict, Bang Lamung District, Chonburi, on a site of approximately 3 Rai 3 Ngan 88 Square Wah, comprising one residential condominium building of 60 storeys with 2 mezzanine floors and 588 units in total.
1.3 Title to the land: the land on which the Project stands is owned by the Company under Title Deed No. 229456, free of encumbrance.
1.4 Permit status: the Environmental Impact Assessment (EIA) was approved on 3 February 2025, and Building Permit (Form Aor.1) No. 28/2568 was issued on 22 October 2025 and expires on 21 October 2027.
Purpose of the advertising and promotional materials
2.1 All text, images, video and promotional materials for the Project are produced to present an overview and the concept of the Project, for the preliminary consideration of interested parties only.
2.2 Advertising material does not constitute a binding offer. A sale and purchase of a unit takes effect only once the parties have signed the sale and purchase agreement and the purchaser has paid in accordance with the agreed conditions.
Renderings and visual presentation
3.1 Renderings and perspectives, graphics, project layouts, unit plans, animations and three-dimensional images are computer-generated to communicate the design concept and the overall atmosphere. They are not photographs of the actual site.
3.2 Materials, colours, finishes, dimensions, proportions, lighting, planting and decorative items shown in the images may differ from the work as built. What the Company is obliged to deliver is set out in the specification of materials and equipment attached to the sale and purchase agreement.
3.3 Layouts and unit plans shown are not to scale. The binding unit area is the area stated in the agreement and in the unit title deed.
3.4 Aerial photographs, images of people, lifestyle images and atmospheric illustrations are used for presentation only and do not show the actual condition of the Project or its surroundings at handover.
Relationship to the sale and purchase agreement
4.1 The Company will keep copies of the advertising text and images, including solicitation materials of every kind, at its place of business until all units are sold, and will deliver at least one set of those documents to the condominium juristic person once it has been registered.
4.2 This disclaimer extends only to identifying material as a rendering, as preliminary information or as an estimate. It is not intended to, and does not, exclude or limit any right of the purchaser under the law.
Changes to the project
5.1 The Company reserves the right to change the details of the Project, the plans, the site layout, unit positions, the schedule of materials or the facilities, to the extent necessary for engineering and architectural suitability, or to comply with the law, local ordinances or conditions imposed by a government authority.
5.2 No change under the clause above shall make the quality, size, usability or value of the property the purchaser is to receive inferior to what is stated in the sale and purchase agreement and its attachments.
5.3 For a change affecting the substance of a unit or of the common property, the Company will proceed by the criteria and the procedure laid down by the condominium legislation and by the sale and purchase agreement.
Prices, promotions and payment terms
6.1 Prices shown in any material are the "starting price" for units of the type, size, floor and orientation the Company has specified. They are not the price of every unit.
6.2 Prices, payment terms and promotions may change without prior notice until the parties have signed the sale and purchase agreement.
6.3 Promotions are limited in number, are available for a specified period and are subject to the conditions the Company announces for each campaign. The start date and the end date of the promotion must be stated in the material every time.
6.4 The prices shown exclude the ownership transfer registration fee, taxes and duties, common area expenses, the condominium juristic person sinking fund, water and electricity meter installation charges, and other expenses specified in the agreement. What is included and what is excluded must be stated clearly in material of every kind.
Completion and transfer of ownership
7.1 Construction completion and ownership transfer dates shown in any material are estimates as at the date the material was produced, and may change with the progress of construction and with government approvals.
7.2 The only dates binding on the Company are those stated in the sale and purchase agreement for the unit.
Views and the surrounding environment
8.1 Images and text showing views are presented from a specific height, position and direction. The view from each unit differs according to the position and the floor level of that unit.
8.2 The Company cannot warrant that a view will remain unchanged, as it may be affected by construction or development on neighbouring land in the future, which is beyond the Company's control.
Amenities outside the project and distance information
9.1 Information about roads, public transport, beaches, shopping centres, educational institutions, medical facilities and other landmarks is referenced from public sources as at the date the material was produced.
9.2 Distances and travel times stated are estimates and depend on the route, the means of travel and traffic conditions at the time.
9.3 Any infrastructure project, transport route or future area development referred to is beyond the Company's control. The Company does not warrant that it will happen or be completed according to the plans announced by the responsible agencies.
Show unit and sales gallery
10.1 The show unit is presented to communicate the design and decoration approach only.
10.2 Furniture, electrical appliances, light fittings, curtains, decorative items, planting and additional decorative work displayed in the show unit and the sales gallery are not included in the sale, unless stated in writing in the schedule of materials attached to the sale and purchase agreement.
10.3 The dimensions, proportions, ceiling heights and service positions of the show unit may differ from the unit as delivered.
Reservations for foreign purchasers
11.1 Ownership of a unit by a foreigner is subject to the Condominium Act B.E. 2522 (1979), under which foreigners and juristic persons treated by law as foreigners may together hold no more than forty-nine per cent (49%) of the total unit area in the condominium building.
11.2 The right to hold ownership depends on the quota remaining at the date of the ownership transfer registration, and on the purchaser having complied with the rules for bringing foreign currency into the Kingdom and having obtained in full the documentary evidence required by law (Foreign Exchange Transaction Form).
11.3 The Company does not warrant that any particular unit can be registered in the ownership of a foreigner until the Company has confirmed the quota status in writing for that specific unit.
11.4 Foreign purchasers should seek advice from their own independent legal and tax advisers before deciding.
Not investment advice
12.1 The Project's materials are not produced as investment, tax, accounting or legal advice.
12.2 The Company does not guarantee any return on investment, rental rate, occupancy rate or future value of the property. Past performance or past prices are not an indication or a confirmation of future results.
12.3 Any reference to returns, to a rental management programme, or to any proposal in the nature of an investment must be approved by the legal department case by case before publication.
Intellectual property
13.1 The Project name, trade marks, logos, images, designs, text and all design work in the Project's materials are the property of the Company or of those it has licensed. They may not be reproduced, adapted, published or used commercially without written permission.
Personal data
14.1 The collection, use and disclosure of the personal data of anyone who contacts or registers with the Project is governed by the Project's privacy notice, published at Privacy Policy.
Governing language
15.1 The Project's materials may be produced in several languages for the convenience of interested parties. Where the versions conflict or differ, the Thai version governs.
Governing law
16.1 This disclaimer is governed by and construed in accordance with Thai law.
